Please carefully read these Terms & Conditions.

By booking with us, you confirm that you and everyone in your party accept & comply with the Terms & Conditions set.

Deposit

If the booking is more than 8 weeks in advance, a minimum 50% deposit will be taken upon booking and must be paid within 48hrs of the confirmation to secure your booking, unless other arrangements have been agreed.  Payment can be made by card via the online booking system or to the bank details for Popham House which will be supplied.

For bookings with less than 8 weeks to the start date, the full amount will be payable upon booking.

If you have not paid in full, we reserve the right to cancel your reservation without refunding your deposit if we do not receive the full balance on time.

Final Payment

The balance of the of the rental fee falls due not less than 8 weeks before the start of your holiday. Should payment not be received your booking may be cancelled and the deposit forfeited.

Cancellation

Any cancellation must be made in writing (email is acceptable).
Cancellation of your booking up to eight weeks prior to your holiday will result in a £50 administration fee and full refund. Cancellation less than eight weeks prior to your holiday will result in the forfeit of the total rental fee. You are advised to take out cancellation insurance to cover this eventuality.

We reserve the right to refuse any booking or to cancel any booking already made subject to refunding any sums you have already paid. The Booker will have no further claim against Popham House

Injury/Loss

The owner of the property cannot be held responsible for any accident, damage, loss, injury, expense or inconvenience suffered by the hirer or any other person in the party or connected to the party.

Risk Assessments

Risk assessments have been carried out and fire safety information is supplied in the Welcome Book.  Please familiarise yourself with these to ensure your own safety.  Details of a fire blanket and fire extinguisher provided are also set out.

The use of candles is not permitted at any time

Smoke Alarms are fitted throughout the house.

Popham House have a strict No Smoking Policy.

Keys

1 set of keys will be left in the key safe and the code given before arrival.  A spare set of keys will be left inside the house as detailed in the Welcome Book.   Please ensure keys are returned as found when you depart. Failure to do so or loss of keys will result extra charges.

Disclosure

Failure to disclose all relevant information or comply with these terms may lead to termination of the contract and loss of booking without a refund.

Damage/Loss

A damage/Loss deposit fee of £150 is payable on booking and will returned if all is found satisfactory within 2 weeks of departure.

The guest agrees to:

Keep the interior of the property in a good clean and tenantable state and condition and not damage or injure the property or any part of it.

The property should be left in the same clean state and condition it was in at the beginning of the term. Reasonable wear and tear and damaged by insured risks accepted

Any damages or breakages should be reported to the Management Team before your departure, details of the management team which will be given to you before your arrival.

All contents of the property form part of an inventory and are to remain in the property including towels and bedding.  Any missing items following departure will be charged for.

Do Not make any alteration or addition to the property nor to do any redecoration or painting of the property.

Not use or occupy the property in anyway whatsoever other than as a private holiday residence for maximum of persons suggested.

Allow the landlord or anyone with the landlords written permission to enter the property at reasonable times of the day to inspect its condition and state of repair and carry out any necessary repairs provided the landlord has given reasonable prior notice (except in emergency)

Subject to the guest paying the rent and performing his/her obligations under this agreement the tenant may peaceably hold and enjoy the property during the term without interruption from the landlord or any person rightfully claiming under or in trust for the landlord

Arrival & Departure Times

Your cottage will be ready from 3.00 p.m. on your arrival day unless otherwise agreed.  The key will be located in the key safe attached to house by the front door. A code will be provided prior to arrival by text or email from the management team. On your departure day, the house must be vacated by 10.00 am unless agreed otherwise

The house must be left in good order as found. All furniture should be returned to the original location. Please ensure all kitchen equipment and utensils are cleaned thoroughly and put away. If the house is left in an unsatisfactory condition (checked after you leave), i.e., breakages, damage, loss of property and postage of any items left at the cottage. The cost will be taken from your damage deposit.

If you are late departing the property, you will be charged a late checkout fee of £10 per hour after 10am unless agreed otherwise. Late departures not agreed can impact on our ability to check arrivals in on time and we respectfully ask that all Holidaymakers comply with the check-out time.

Obligations of the Hirer

The number of persons in the party must not exceed the number confirmed on the booking form, which must not be greater than the house is designed to accommodate. If the number exceeds the number confirmed on the booking form your booking may be cancelled and you may be asked to leave with no refund made.

Please tell us straight away about any problems. Emergency contact details are in the welcome pack in the cottage.

Please be respectful of immediate neighbours and other residents in the area. Many neighbours are permanent residents and we rely on our guests respecting the peace and quiet environment in communal areas and within the site to continue our business.

We cannot consider compensation for complaints raised after you leave or if you won’t let us try to put things right while you are with us.

Electricity, heating, bed linen & towels are all included there are also beach towels available for use.

Parking is available on the quay free of charge but if this is not possible there are two car parks available, one at the end of the quayside opposite the Seagate and the other above in Odun road.  You can unload outside the property before you park in the loading bay.

The Proprietor

The proprietors reserve the right to refuse any booking or to cancel any bookings already made subject to refunding any sums you have paid without further liability on your behalf.

The proprietors reserve the right to terminate your stay if you, or any member or members of your party, are believed to be causing a nuisance or are not treating the property with due respect.

The proprietors shall not be liable to you, or any other member of your party, for any loss or damage to you or to your property however caused.

The proprietors reserve the right to enter the property during your stay.

If for any reason beyond the proprietors’ control the property is not available on the date booked (owing to fire damage for example), or the property is unsuitable for holiday letting, all rent and charges paid in advance by the applicants will be refunded in full, but the applicants shall have no further claim against the proprietors.

The proprietors reserve the right to cancel any booking or terminate the tenancy, without prejudice to the other rights and remedies of the proprietors, if it subsequently transpires that any of these conditions have not been observed. 

Pets

Popham House are happy to accommodate two well behaved dogs unless otherwise agreed.  Please refer to our ‘dog rules’ on our website and welcome pack and ensure they are adhered to.  Failure to comply to the rules could result in additional costs.

General Conditions

The tenancy confers upon the Tenants the right to occupy for a holiday within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988.

The person who completes the booking form certifies that: a) he or she is authorised to agree the booking conditions on behalf of all persons included on the booking form, including those substituted or added at a later date; b) the signatory is over eighteen years of age and a member of the party intending to occupy the property; and c) agrees to take responsibility for the party occupying the property.

English law shall govern the validity, construction and performance of this Agreement. If any term or provision in these booking conditions shall in whole or in part be held to any extent to be unenforceable under any enactment or rule of law that term or provision or part shall to that extent be deemed not to form part of this agreement and the enforceability of the remainder of this agreement shall not be affected.

These booking conditions replace and supersede all previous booking conditions.

Data Protection

Any personal data you give to us will be processed in accordance with the law. Any information you provide us with i.e., names, addresses, phone details, email will only be used by office staff to contact you regarding business. We will not share it with an associated business or with third parties and will only release the details we have if the law requires us to do so. We will only retain your data whilst we still need it.
